Please read these Terms of Service ("Terms") carefully before using familypoolandspaid.com (the "Site") or purchasing products or services from Family Pool & Spa LLC ("we," "us," "our," "Family Pool & Spa"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. About Us
Family Pool & Spa LLC is a family- and locally-owned, licensed and insured retailer based at 4902 W Chinden Blvd, Boise, ID 83714, serving the Treasure Valley (Boise, Nampa, Meridian, Eagle, and surrounding areas). We sell hot tubs, swim spas, cold plunges, and related supplies, and offer installation and maintenance services.

2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on the Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.
3. Products, Descriptions, and Pricing
- We make reasonable efforts to display product details, dimensions, specifications, and images accurately, but colors, finishes, and features may vary slightly from what's shown due to manufacturer changes, display settings, or photography.
- Prices are listed in USD and are subject to change without notice. Promotional codes (such as a first-purchase discount) apply under the terms stated at the time of offer and may not be combined with other offers unless specified.
- In the event of a pricing or listing error, we reserve the right to cancel or refuse any order, even after confirmation, and will notify you and issue a refund if payment was already collected.
- Product availability is not guaranteed until your order is confirmed; large items like hot tubs and swim spas may be subject to manufacturer lead times.
4. Orders and Payment
- By placing an order, you're making an offer to purchase, which we may accept or decline.
- Payment is processed at checkout through Shopify Payments or another supported payment method. You authorize us (and our payment processor) to charge your chosen payment method for the full order amount, including applicable taxes and shipping/delivery fees.
- We reserve the right to refuse or cancel orders we suspect are fraudulent, in error, or otherwise improper.
5. Shipping and Delivery
Shipping and delivery timelines, methods, and fees are described in our Shipping Policy. Large items such as hot tubs, swim spas, and cold plunges may require freight delivery or scheduled local delivery, and delivery dates are estimates rather than guarantees.
6. Installation Services
If you purchase installation services from us:
- You are responsible for ensuring the installation site is accessible, structurally adequate, and ready (including any required electrical, plumbing, or pad/foundation work) by the scheduled date, unless we've agreed in writing to handle that prep.
- You're responsible for obtaining any permits required by your local jurisdiction, unless otherwise agreed.
- Electrical hookups for hot tubs, swim spas, and cold plunges should be performed by a licensed electrician in accordance with local code; we are not responsible for site conditions or third-party work outside our scope of service.
- Rescheduling, site-access issues, or site readiness problems discovered on installation day may result in additional fees or rescheduling.
7. Returns, Refunds, and Cancellations
Our return, refund, and cancellation terms are described in our Refund Policy. Custom or special-order items, used chemicals/supplies, and certain large equipment may not be eligible for return once delivered or installed — please review the Refund Policy for details before purchasing.
8. Warranties
- Hot tubs, swim spas, cold plunges, and equipment we sell may be covered by a manufacturer's warranty. Warranty terms, coverage, and claims processes are set by the manufacturer, and we'll help facilitate warranty claims where possible.
- Except for any manufacturer warranty or as required by law, products and services are provided "as is" without additional express or implied warranties, including warranties of merchantability or fitness for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, Family Pool & Spa LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products/services, including but not limited to property damage, loss of use, or personal injury arising from improper use, installation, or maintenance of hot tubs, swim spas, or cold plunges not performed by us.
Our total liability for any claim related to a purchase will not exceed the amount you paid for the product or service giving rise to the claim.
Nothing in these Terms limits liability where it cannot legally be limited, such as for gross negligence, willful misconduct, or as otherwise required by applicable law.
10. Assumption of Risk – Spa, Hot Tub, and Cold Plunge Use
Hot tubs, swim spas, and cold plunges involve inherent risks, including risks related to water temperature, electrical components, and slip hazards. You agree to follow manufacturer instructions, posted safety guidance, and applicable health/safety recommendations (such as those regarding pregnancy, certain medical conditions, and supervision of children) when using this equipment. Use of any product purchased from us is at your own risk.
11. User Conduct
When using the Site, you agree not to:
- Violate any applicable law or regulation
- Use the Site for any fraudulent or unauthorized purpose
- Attempt to interfere with the Site's security or functionality
- Submit false, misleading, or harmful content (including reviews or testimonials)
- Scrape, copy, or republish Site content without our permission
We reserve the right to suspend or terminate access for anyone who violates these Terms.
12. User-Generated Content
If you submit reviews, testimonials, comments, or other content to us (including via email, social media, or the Site), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with marketing our products and services. You're responsible for ensuring you have the right to share any content you submit.
